First amendment to the Utility Regulatory Authority Act of Maldives [Law no. 26/2020]
On 31st October 2022, the first amendment to the Utility Regulatory Authority Act of Maldives (Law no. 26/2020) was ratified.
With the addition of a new clause under Section 34 of the Act, the Utility Regulatory Authority in consultation with the utility providers are required to formulate a regulation setting out the main principles to be followed in billing recipients of public utility services in respect of those services.
The regulation is required to include the following.
(1) Rules relating to the determination of a single period billing cycle.
(2) Rules for determining the minimum period for payment of bills.
(3) The circumstances and manner in which concessions may be granted.
(4) Procedures for determining penalties for non-payment of bills.
(5) Prescribing the circumstances under which the service would be discontinued for non-payment of bills and the procedures which must be followed in such circumstances.
It is also stipulated in the amendment that for public utility services provided through the meter, the meter shall be registered in the name of the owner of the building. If the service is used by a person other than the person to whom the meter is registered, the service may be registered with the service provider in the name of the person using the service. The Utility Regulatory Authority is required to formulate a regulation describing all the rules and regulations for doing this.
